  20. SUMMARY: In accordance with 24 CFR 115.6(c), this notice announces the
  21. Department's initial determination that the fair housing laws of the States of
  22. Massachusetts and Nebraska are substantially equivalent, on their face, to the
  23. Fair Housing Act. This notice solicits comments from the public on the initial
  24. determinations made with respect to each State. This notice also solicits
  25. comments on the Department's proposed determinations that the present
  26. practices and past performance of the agency enforcing the fair housing law of
  27. the State of Massachusetts and the agency enforcing the fair housing law of
  28. the State of Nebraska demonstrate that, in operation, the fair housing laws of
  29. these two States provide rights and remedies that are substantially equivalent
  30. to those available under the Fair Housing Act.

  47. SUPPLEMENTARY INFORMATION:

  49. Background
  50.  
  51. Under the Fair Housing Act (42 U.S.C. 3600─3619), the Department is authorized
  52. to investigate complaints alleging discrimination in housing. (Title VIII of
  53. the Civil Rights Act of 1968, as amended by the Fair Housing Amendments Act of
  54. 1988, is cited as the "Fair Housing Act.") Section 810(f) of the Fair Housing
  55. Act requires the Department to refer complaints to State and local agencies
  56. that have "substantially equivalent" fair housing standards, as determined and
  57. certified by the Department. Part 115 of the Department's regulations (24 CFR
  58. part 115) contain the certification standards and the procedures for
  59. certifying State and local fair housing laws that provide substantive rights
  60. and remedies for alleged discriminatory housing practices that are
  61. substantially equivalent to those provided in the Fair Housing Act.
  62.  
  63. On July 23, 1993 (58 FR 39561), the Department published the annual notice
  64. required by 24 CFR 115.6, which announced, among other things, the updated,
  65. consolidated list of all certified agencies, and a list of agencies with which
  66. an agreement for interim referrals or other utilization of services had been
  67. entered into under 24 CFR 115.11. In the July 23, 1993 notice, the Department
  68. listed thirty-four jurisdictions, among which were the States of Massachusetts
  69. and Nebraska, that had entered into agreements with the Department, subsequent
  70. to September 12, 1988, for interim referrals. These thirty-four jurisdictions
  71. were considered to have interim certification in accordance with section
  72. 810(f)(4) of the Fair Housing Amendments Act of 1988 (hereafter the "Act").
  73. (The Fair Housing Amendments Act of 1988 was enacted on September 13, 1988.)

  75. Announcement of Initial Determinations and Solicitation of Comments
  76.  
  77. In accordance with 24 CFR 115.6(c)(1), this notice announces that the fair
  78. housing laws of the States of Massachusetts and Nebraska have been determined
  79. by the Assistant Secretary of Fair Housing and Equal Opportunity to be
  80. substantially equivalent, on their face, to the Fair Housing Act. The
  81. Assistant Secretary has determined, after application of the criteria set
  82. forth in 24 CFR 115.3 and 115.4, that the fair housing laws for the States of
  83. Massachusetts and Nebraska provide, on their face, substantive rights and
  84. remedies for alleged discriminatory housing practices that are substantially
  85. equivalent to those provided in the Fair Housing Act.

  87. Following, a review of performance standards and other materials pertaining to
  88. the fair housing laws of the States of Massachusetts and Nebraska, the
  89. Department expects to make final determinations that the laws of each State,
  90. in operation, provide rights and remedies that are substantially equivalent to
  91. those available under the Fair Housing Act. The Department intends to execute
  92. a Memorandum of Understanding with the agency charged with enforcement of the
  93. fair housing law of each State in accordance with 115.6(c).

  95. In accordance with 24 CFR 115.6(b), the public is invited to submit written
  96. comments on this notice. Specifically, the Department requests written
  97. comments on the proposed determinations that the current practices and past
  98. performance of the State agencies charged with administration and enforcement
  99. of the fair housing laws of the States of Massachusetts and Nebraska
  100. demonstrate that, in operation, these laws provide substantive rights and
  101. remedies that are substantially equivalent to the Fair Housing Act. This
  102. notice also invites comments from the public on the Department's determination
  103. that the fair housing laws of the States of Massachusetts and Nebraska are, on
  104. their face, substantially equivalent to the Fair Housing Act. In commenting on
  105. this notice, the Department requests that commenters identify the State for
  106. which comments are submitted.
